What is a finiquito?
A finiquito is the written settlement that records the termination of the employment relationship and summarises the amounts owed to the worker. Chile’s Law 21.361 allows finiquitos and other termination documents (mutual agreements and resignations) to be signed electronically, provided that the employer informs the worker whether the settlement will be delivered and paid electronically or in person and the worker can choose either option. If the worker declines the electronic method, the employer must deliver a paper settlement within three business days. The employer must also make the payment available within ten working days of termination.
