Use and processing of geolocation data in Legale.io

Legal basis, informed consent, and personal data protection #

At Legale.io, we understand that the use of digital technologies applied to electronic signatures requires a strict commitment to safeguarding individuals’ rights, especially their right to privacy and the legitimate processing of their personal data, as established by Law No. 19.628 on the Protection of Private Life (Chile), and the provisions on electronic signatures contained in Law No. 19.799.

In this context, we inform our users that, at the moment of executing an electronic signature—particularly when such signature must be backed by or equivalent to a notarial process (e.g., advanced electronic signature validated by or linked to a notary)—it may be necessary to request and record their approximate geographic location, which is obtained only with the user’s explicit authorization through geolocation services provided by their browser or mobile device.

Purpose of processing geolocation data #

The capture of your geographic location serves the following purposes:

  1. To determine the territorial jurisdiction of the legal act, in accordance with Chilean notarial law, enabling:

    • The valid assignment of the competent notary based on your location.

    • Compliance with territorial requirements, where certain signatures are valid only if executed within the jurisdiction of the notary who authorizes or certifies the document.

  2. To provide additional evidence of physical presence or remote location, which strengthens the legal traceability, integrity, and non-repudiation of the signature event.

  3. To comply with international standards of digital governance, including principles of accountability, data minimization, and user control.

Legal basis for data processing #

The processing of this data is carried out in accordance with:

  • Law No. 19.799 on Electronic Documents and Electronic Signatures, which sets forth the legal and technical requirements for electronic signatures in Chile.

  • Law No. 19.628 on the Protection of Private Life, particularly Articles 2, 4, and 7, which regulate the legitimate processing of sensitive data and informed consent.

  • Criteria and guidelines from the Chilean Council for Transparency’s Personal Data Protection Unit.

  • International best practices recommended by organizations such as the OECD, United Nations, and Convention 108+ of the Council of Europe regarding the use of location data in digital services.

Protection, storage, and deletion #

  • Location data will not be used for marketing, profiling, or ongoing tracking purposes.

  • Data will be securely stored in encrypted format and access will be restricted, with the geolocation data linked to the digital signature event.

  • The information will only be retained for the time required to legally validate the transaction and to meet auditing or traceability requirements established by law.

Explicit consent #

Users may provide their freely given, specific, informed, and unambiguous consent via an opt-in checkbox before geolocation services are activated. No location data will be captured or stored without this consent.

Final considerations #

Legale.io will not share your location data with third parties unless required by a judicial authority or in accordance with a valid legal process.

The processing of your location data complies with the principles of lawfulness, purpose limitation, proportionality, and data security, and forms a legally integral part of the electronic signing process when required by Chilean regulations or institutional client compliance frameworks.
